Distance Sales Agreement
This Distance Sales Agreement ("Agreement") is entered into electronically between the parties described below and governs the terms under which travel-related services are sold remotely by Cappadocia High Travel Agency.

1. PARTIES

BUYER (Consumer):
Any individual who books services through the Seller’s website, social media platforms, messaging applications (e.g. WhatsApp), email, or other remote communication tools.
By confirming a reservation and submitting required personal details, the Buyer is deemed to have read, understood, and accepted this Agreement.

2. SUBJECT OF THE AGREEMENT
This Agreement governs the sale and provision of tourism-related services offered by the Seller — including but not limited to hot air balloon flights, ATV tours, jeep safaris, guided excursions, and transportation — via remote means of communication.
Full details of each service (including price, inclusions, and timing) are provided to the Buyer prior to booking and are considered part of this Agreement once a reservation is confirmed.

3. PRICE AND PAYMENT
• Prices are stated in Euro (€) unless otherwise specified.
• The Seller may require full payment or a deposit in advance.
• Accepted payment methods include credit/debit card, bank transfer, or cash upon arrival (if available).
• If payment is not made within the agreed time, the Seller reserves the right to cancel the reservation.
• Additional charges (such as transaction fees from banks or payment providers) may apply depending on the payment method.

4. CANCELLATION & REFUND POLICY
✅ Free cancellation is permitted up to 24 hours before the scheduled service time.
• Cancellations made at least 24 hours in advance are fully refundable.
• Cancellations made less than 24 hours before the service start time are non-refundable.
• If the service is cancelled by the Seller due to weather conditions or operational issues (e.g. balloon flight cancellations), a full refund will be offered to the Buyer via the original payment method.
• Refunds for card or online payments may be subject to transaction deductions applied by third-party payment processors.

5. RIGHT OF WITHDRAWAL
In accordance with Article 15 of Türkiye’s Distance Contracts Regulation, the right of withdrawal does not apply to services related to accommodation, transportation, car rental, catering, or leisure activities provided at a specific date or time.
Therefore, the Buyer does not have a right of withdrawal for the services covered under this Agreement.

6. LIMITATION OF LIABILITY
The Seller shall not be held liable for any indirect, incidental, or consequential damages.
In any case, the Seller’s liability shall not exceed the total amount paid by the Buyer for the relevant service.

7. PERSONAL DATA PROTECTION
The Seller agrees to process the Buyer’s personal data (such as name, passport number, nationality, date of birth) in accordance with Law No. 6698 on the Protection of Personal Data (KVKK) and relevant legislation.
Personal data will only be used for the purpose of booking, legal requirements, and service delivery, and will not be shared with third parties without consent, except where legally required.

8. GOVERNING LAW AND JURISDICTION
This Agreement shall be governed by and interpreted in accordance with the laws of the Republic of Türkiye.
In the event of a dispute, the Buyer may apply to the Consumer Arbitration Committees or Consumer Courts located in NevÅŸehir, Türkiye.

9. MODIFICATION OF TERMS
The Seller reserves the right to modify, update, or revise this Agreement at any time without prior notice.
The version published on the Seller’s website at the time of booking shall apply to the transaction.
Buyers are responsible for reviewing the latest version of the Agreement before confirming their reservation.

10. ACCEPTANCE OF THE AGREEMENT
By completing a booking and providing the required personal information, the Buyer acknowledges and agrees to the terms of this Distance Sales Agreement.
This agreement becomes legally binding without the need for a physical signature, upon the Buyer’s confirmation via digital communication (such as email, WhatsApp, online form, etc.).
✅ This Agreement is considered accepted once the Buyer confirms a reservation in writing or submits personal details for the booking.
